Judge Dismisses NASCAR’s Countersuit to 23XI, Front Row
On Tuesday, Judge Kenneth D. Bell dismissed NASCAR’s antitrust countersuit against 23XI Racing and Front Row Motorsports, which alleged that teams were conspiring and colluding to reach more favorable terms in Charter negotiations.
Judge Bell ruled that NASCAR failed to document any proof showing that any individual or collective negotiations from teams to NASCAR resulted in any more favorable terms from a Charter revenue standpoint.
This means that the antitrust lawsuit trial (23XI/Front Row vs NASCAR), which is scheduled for December 1, will focus solely on whether NASCAR has operated as a monopsony. That is, if a settlement isn’t reached between the sanctioning body and teams before the trial.

Sam Mayer Suspended for Xfinity Season Finale After Run-In With Jeb Burton
NASCAR has issued a one-race suspension for NASCAR Xfinity Series driver Sam Mayer following a post-checkered flag run-in with Jeb Burton in Turn 1 on the cooldown lap of last weekend’s IAA and Ritchie Bros. 250 at Martinsville Speedway.
Haas Factory Team will not appeal the penalty, and Ryan Sieg will fill in as the driver of the team’s No. 41 Ford Mustang this weekend at Phoenix. This will mark Sieg’s 400th career NASCAR Xfinity Series start.
Additionally, NASCAR issued a two-race suspension for two pit crew members of the No. 51 Rick Ware Racing NASCAR Cup team for a detached wheel during last Sunday’s race, and an indefinite suspension of Shane Gray, the dad of NASCAR Xfinity race winner Taylor Gray.
